摘要 Amarketeconomyrequirestheindividualrightsofcitizensbeprotected,andthattheexercisingofthoserightsberegulated,whoserealizationdependsonthelegalizationofhumanrightsprotectionOntheonehand,individualrightsmustbeprotectedbylawOntheotherhand,alaw-basedsocietyneedstobebuiltsotheboundariesofindividualrightsareclear,theexercisingofthoserightsareregulated,conflictsbetweenrightscanberesolvedthroughthecourts,andthepersonalinfringementofothers’rightsandtheoverallinterestsofthesocietyisprohibitedbylawDuringthe40yearsofChina’sreformandopening-upinChina,thepromotionofthelegalprotectionofhumanrightsmainlyliesinthreeaspects:first,theimportantroleoftheruleoflawplaysinprotectinghumanrightshasbeenclarified;second,thefourstepsoftheruleoflaw(scientificlegislation,strictlawenforcement,judicialjusticeandobservanceofthelawbyallChinesecitizens)havebeenstrengthenedtosafeguardhumanrightsfullyandeffectively;third,theChinesehumanrightssystemundertheruleoflawhasgraduallybeenalignedwithinternationalnorms.
