简介：InWTOdisputesettlement,theissueaboutthecharacterizationofnationallawinterpretationisconcernedwithjudicialdeferenceandtheallocationofpowerbetweentheWTOandMemberStates.ThisarticleexaminesWTOtribunals＇claimabouttheircharacterizationofnationallawinterpretationandtheirpractice.Ontheonehand,WTOtribunalshaveclaimedtocharacterizenationallawinterpretationasaquestionoflaw;ontheotherhand,theyhaveappliedthesameruleontheburdenofprooffornationallawinterpretationwiththatforotherfactsandprovideddeferencetothelegislatingstatesespeciallyinthecircumstanceswherethereisanysuspicionoruncertaintyaboutthemeaningofnationallaw.Therefore,WTOtribunals＇claimaboutthecharacterizationisnotconsistentwiththeirpractice.WTOtribunals＇nationallawinterpretation,inessence,isreinterpretationofnationallaw,andshouldbecharacterizedasamixedquestionoflawandfact.

简介：Theadventoftheinterneterabreedsanewconcept,namely,therighttointernetaccess.Manycountriesandinternationalorganizations,aswellasindividuals,areadvocatingorhavealreadyembodieditasabasichumanright,thusenhancingtheissuesofwhetheritshouldbeincorporatedintothemacrosystemofinternationalhumanrights.Byanalyzingthefacts,thisarticlepointsoutthattheinternationalconceptoftherighttointernetaccessshouldbedistinguishedfromitsdomesticconcept,fortherearenolegalsourcesabouttherighttointernetaccessforguidanceaswithsometreatiesinthecurrentinternationallaw,despiteitscloserelationshipwithsomeexistingrightssuchasthefreedomofspeech,pressandassembly,ortherightofequality,ortherighttodevelopment.Andthereisstillalongtimebeforethelegalvalueandrelatedresponsibilitiesaswellastheboundariesabouttherighttointernetaccessbecomesaconsensusintheinternationalsociety.Eventhoughthereisquiteapossibility,thisrighthasn’tbeenembodiedaspartofinternationalhumanrights,andthushasn’tmadealegalconceptininternationalhumanrightlaw.
