简介：涉诉信访工作已成为法院的日常事务之一,却缺少对此的深入研究,特别是对其的实证研究。我们在借用其他学者对信访研究的分类概念,将信访分为(涉诉)有理信访、(涉诉)无理信访和(涉诉)商谈型信访,以实证方法深入讨论涉诉无理信访问题。通过分析,法院中处理(涉诉)无理信访案件的两种程序均无法实质上终结案件,究其原因有三:中国人的权利观、诉讼观和纠纷解决观在转型时期的错位,信访人的基本特点,行政命令性的'维稳'政策。最后,我们根据这些原因提出了相应的三条建议,即转变当前的'维稳'政策,加强公民教育和对无理信访案件的宣传,同时也应通过一种'仪式'方式回应已经在法律和(法院内部)程序上终结的信访案件。

简介：揭示＂联村制度＂的时空差异性和一般运行机制,并分析＂联村制度＂的存在对乡镇治理利益密集型村庄所发挥的作用,是本文的研究目标。本文采用田野调查的质性研究方法,在对官僚制理论进行反思的基础上,提出了不同于＂村级组织官僚化＂的另一种乡镇治理模式。在以M村为代表的利益密集型村庄,派性政治对村社利益连带与情感连带的切割,使村干部不再是整个村社意志的代表,也不再对整个村社关系网络具有谈判力和动员力,村社出现＂治理无主体化＂的现象。作为应对策略,乡镇行政要充当村级治理的主体,调和各方利益,以超越派系和既得利益集团,成为以非科层化方式运作的＂中间权威＂。本文通过分析利益密集型地区＂联村制度＂运行机制,将推进对乡镇行政与村级治理关系的研究。
